Termination

Depending upon the severity of the indiscretion, one may be given an opportunity to rectify the situation or in extreme circumstances, at the discretion of Foundation Surgical Center of Dickinson and/or [Management Company], privileges will be revoked immediately. Contractors agree that any such termination of account or membership may be effected without any prior notice and agree that Foundation Surgical Center of Dickinson and/or [Management Company] shall not be liable to the contractor or any third-party for any such termination.

Miscellaneous

The failure of Foundation Surgical Center of Dickinson and/or [Management Company] to exercise or enforce any right or provision of the Terms and Notices shall not constitute a waiver of any right or provision.
